§ 1 Geltungsbereich und Anbieter (1) Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen, die Verbraucher über den Online-Shop von: Dark Hearts Society | Celebrate your Dark Side Inhaber: Dennis Czerwanski An den Eichen 12, 63933 Mönchberg, Deutschland E-Mail: shop@darkheartssociety.de Telefon: 015679719508 (nachfolgend "wir" oder "Dark Hearts Society" genannt) tätigen. (2) Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können (§ 13 BGB).

§ 2 Vertragsschluss (1) Die Präsentation der Waren in unserem Online-Shop stellt kein rechtlich bindendes Vertragsangebot unsererseits dar, sondern ist nur eine unverbindliche Aufforderung an den Verbraucher, Waren zu bestellen. (2) Mit der Bestellung der gewünschten Ware durch Anklicken des Buttons „Jetzt kaufen“ (oder einer ähnlichen eindeutigen Bezeichnung) im letzten Schritt des Bestellprozesses gibt der Kunde ein verbindliches Angebot auf Abschluss eines Kaufvertrages ab. (3) Der Kaufvertrag kommt zustande, wenn wir das Angebot des Kunden annehmen, indem wir eine separate Auftragsbestätigung per E-Mail versenden oder die Ware versenden.

§ 3 Widerrufsrecht & Zölle (1) Verbrauchern mit Wohnsitz innerhalb der Europäischen Union (EU) steht ein gesetzliches Widerrufsrecht zu. Nähere Informationen ergeben sich aus unserer separaten Widerrufsbelehrung. (2) Bei Lieferungen in Länder außerhalb der EU (internationaler Versand) können zusätzliche Zollgebühren und Einfuhrsteuern anfallen. Diese sind vom Kunden zu tragen und nicht im Kaufpreis enthalten.

§ 4 Preise, Versandkosten und Zahlungsbedingungen (1) Alle Preise sind Endpreise in Euro (€) inkl. MwSt. (2) Zusätzlich fallen Versandkosten an. Ab einem Bestellwert von 44,51 € liefern wir innerhalb Deutschlands versandkostenfrei. Für alle anderen Regionen gelten die im Checkout angegebenen Tarife. (3) Die Zahlung erfolgt über die im Checkout angebotenen Methoden.

§ 5 Liefer- und Versandbedingungen (1) Da unsere Produkte auf Bestellung gefertigt werden (Print-on-Demand), setzt sich die Lieferzeit aus Produktion und Versand zusammen. (2) Ungefähre Gesamtlieferzeiten:

  • Deutschland: ca. 3–7 Werktage

  • EU-Ausland: ca. 5–14 Werktage

  • Rest der Welt: ca. 12–25 Werktage

§ 6 Eigentumsvorbehalt Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.

§ 7 Mängelhaftung (Gewährleistung) Es gelten die gesetzlichen Bestimmungen zur Mängelhaftung.

§ 8 Haftung Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie bei Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung einer wesentlichen Vertragspflicht.

§ 9 Streitschlichtung Die EU-Kommission bietet eine Plattform zur Online-Streitbeilegung: https://ec.europa.eu/consumers/odr/. Wir sind zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle nicht verpflichtet und nicht bereit.

§ 10 Schlussbestimmungen (1) Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. (2) Die Vertragssprache ist Deutsch. Die englische Fassung dient lediglich der Information. Im Falle von Widersprüchen ist die deutsche Fassung maßgeblich.

§ 1 Scope and Provider (1) These General Terms and Conditions (GTC) apply to all orders placed by consumers via the online shop of: Dark Hearts Society | Celebrate your Dark Side Owner: Dennis Czerwanski An den Eichen 12, 63933 Mönchberg, Germany Email: shop@darkheartssociety.de Phone: 015679719508 (hereinafter referred to as "we" or "Dark Hearts Society"). (2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

§ 2 Conclusion of Contract (1) The presentation of goods in our online shop does not constitute a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order goods. (2) By clicking the "Buy Now" button (or similar) in the final step of the ordering process, the customer submits a binding offer to conclude a purchase contract. (3) The contract is concluded when we accept the offer by sending an order confirmation or by shipping the goods.

§ 3 Right of Withdrawal & Customs (1) Consumers residing within the European Union (EU) have a statutory right of withdrawal. Further information can be found in our separate Return & Refund Policy. (2) For deliveries to countries outside the EU (international shipping), additional customs duties and import taxes may apply. These are to be borne by the customer and are not included in the purchase price.

§ 4 Prices, Shipping Costs, and Payment (1) All prices are final prices in Euro (€) including VAT. (2) Shipping costs apply additionally. For orders over 44.51 €, we provide free shipping within Germany. For all other regions, the rates specified in the checkout apply. (3) Payment is made via the methods offered in the checkout process.

§ 5 Delivery and Shipping Conditions (1) Since our products are made to order (Print-on-Demand), the delivery time consists of production and shipping. (2) Estimated total delivery times:

  • Germany: approx. 3–7 business days

  • European Union: approx. 5–14 business days

  • Rest of the World: approx. 12–25 business days

§ 6 Retention of Title The goods remain our property until full payment has been made.

§ 7 Liability for Defects (Warranty) Statutory warranty regulations apply.

§ 8 Liability We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health. In the case of slight negligence, we are only liable for the breach of an essential contractual obligation.

§ 9 Dispute Resolution The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Final Provisions (1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. (2) The language of the contract is German. The English version is for informational purposes only. In the event of any discrepancies, the German version shall prevail.
